DAGO Pinsa GmbH (referred to below as “DAGO”, “we”, “us”) attaches great importance to protecting the data and privacy of our users and customers (referred to below as the “users”). We treat our users’ personal data as confidential, in compliance with the statutory regulations on data privacy, and also in accordance with this Data Privacy Statement. The Data Privacy Statement provides the user with a transparent overview of how, and to what extent, we collect, process, store and protect personal data, taking account of the basic principles of the Swiss Federal Data Protection Act (referred to below as the “DPA”).

Dago operates the www.dagopinsa.ch website (referred to below as the “website”).
2. GENERAL INFORMATION ABOUT DATA PROCESSING
Personal data is all data relating to a defined or definable natural person or legal entity. This data includes, for example, the name, address, telephone number and email address.
Our customers’ personal data is processed only to the extent required in order to provide a functioning website, our content and services (including the online order service in particular). In regular cases, processing of data takes place only after the user has given consent. An exception applies in cases where it is impossible to obtain prior consent for factual reasons, and the processing of the data is permitted by statutory regulations.
Data entered by the user when placing the purchase order and/or when registering is transmitted to us and is saved by us.
By disclosing the data, the user explicitly gives consent to the use of the data as described in this Data Privacy Statement.
No personal data of users is processed if our website is visited purely for information purposes.
3. USE OF THE WEBSITE AND GENERATION OF LOG FILES
Whenever our website is accessed and used, our system will also automatically collect and store general data and information including, in particular, server log files (e.g.: the user’s IP address, date and time of access to our website, etc.). This data is not merged with other data sources.
4. FORWARDING OF USER DATA TO THIRD PARTIES AND PROCESSING
User data is forwarded to third parties if, for the purpose of performing our services, we engage third parties as processors, and also in connection with marketing activities intended to improve our customers’ marketing experience. These third parties process the data exclusively on our behalf, and they are contractually obligated only to process personal user data for purposes within the scope of this Data Privacy Statement and in compliance with the provisions of data protection law (including necessary security measures). Data is not processed by third parties for their own purposes.
Furthermore, unencrypted user data is forwarded to third parties only if (i) we are obligated by law to do so, (ii) if the user has issued his/her consent to us, or (iii) if it is necessary to do so in order safeguard our legitimate interests.
5. FORWARDING OF USER DATA TO THIRD COUNTRIES
In connection with the fulfilment of our obligation, it can also happen that data is forwarded to foreign countries. We point out that it is possible that the storage, processing and forwarding of personal data in foreign countries may be subject to regulations which differ from those applicable in Switzerland. In such cases, we will implement appropriate contractual security precautions so that any recipients in foreign countries are obligated to comply with the same data protection standards.
6. TECHNICAL AND ORGANIZATIONAL MEASURES
When processing data, we make use of suitable technical and organisational measures to ensure that personal data is protected against partial or total loss, unauthorised access by third parties, and manipulation.
7. COOKIES AND TRACKING PIXELS
When our website is visited, we make use of what are known as cookies and tracking pixels (web beacons). Cookies are small text files that are stored in the browser on the user’s computer. They do not contain any information that can directly identify the individual user. The purpose of these cookies is to track and analyse the user’s surfing behaviour on our website and to store settings. We use cookies to optimise the content of our website and to make it more user-friendly. Most of the cookies we use are what are known as “session cookies”. They are deleted automatically after the end of the visit to our website. Other cookies remain stored on the user’s computer until the user deletes them. These cookies enable us to recognise the user’s browser again on the next visit. In their browser settings, users can turn off the use of cookies, implement a restriction or deactivation of the cookies, or delete them either automatically or manually.
Tracking pixels are small graphics that enable us to record and analyse log files; they are used for statistical evaluations and also for marketing purposes.
We wish to point out that total or partial deactivation of cookies and blocked tracking pixels can make it impossible for users to use our website, or to make full use of the website.
8. WEB ANALYTICS, TOOLS FROM THIRD-PARTY PROVIDERS AND SOCIAL NETWORKS
Web analytics
For the statistical evaluation of users’ surfing behaviour, our website makes use of what are known as web analytics tools such as Google Analytics. These analytics services use cookies on the user’s computer (see clause 7).
In order to guarantee the protection of the user’s personal data, we use a function that only processes the user’s IP address in shortened form, in order to prevent any direct personal reference (IP anonymisation). The user’s personal data that we collect may be transmitted to a server that uses the aforementioned tools, which may also be located in a foreign country. Appropriate data transfer agreements are in place between the aforementioned tools and ourselves (see clause 5).
Tools from third-party providers
In order to show the locations of our business premises, our website uses the Google Maps map service, which makes use of a plugin. Our website also uses the “Google Web Fonts” tool.
By using our website, the user states his/her agreement to the recording, processing and use of automatically collected data by Google Inc., its representatives, and third parties.
Social networks
Our website uses plugins of various social networks such as YouTube, Facebook and LinkedIn.
These are integrated by means of links to the respective social networks and by direct embedding of individual contents of our website on the respective social networks.
These plugins are buttons on our website. No data is sent to the respective social networks if the user takes no action. It is only by clicking on the buttons that a connection with the respective social network is established; the network can then collect data and place cookies. We have no influence over the scope of user data collected by the respective social networks with the plugins. If the user is logged in to the respective social network, it can allocate the visit by the user of our website to the user account with the social network.
Information about the purpose and scope of data collection, the further processing and use of the data by the respective social networks, and also the user’s rights in this regard and the setting options to protect the user’s privacy, can be found in the conditions of use and data privacy information of the relevant social networks.
9. NEWSLETTER
On our website, we offer users the option of subscribing to a Newsletter. The user’s consent to processing of the data is obtained during the registration process, when reference is also made to this Data Privacy Statement. The user may withdraw this consent at any time. A note to this effect is included whenever the Newsletter is sent via email.
Data entered by the user in the input mask for the subscription is used exclusively in order to send the requested information and the Newsletter, and is not forwarded to third parties.
10. CONTACT FORM AND CONTACT VIA EMAIL
Users have the option of addressing electronic enquiries to us via the contact form provided on our website. The data disclosed in this contact form is stored by us for the purpose of processing the issue concerned and any subsequent questions, and is not passed on to third parties.
11. USER RIGHTS
Pursuant to Art. 8 DPA, users may at any time request information about the stored data that relates to them personally.
Users may revoke their consent to processing of personal data at any time via email, with no need for a specified form. The legality of data processing that has taken place until such revocation shall remain unaffected by the revocation.
12. STORAGE PERIODS
Collected and saved data is stored for as long as it is required for the stated purpose, or as long as we have a legitimate interest, or until the user explicitly revokes his or her consent (insofar as the data processing was based on such consent). Data may also be stored beyond these periods if provision for such storage has been made in the applicable laws, ordinances or other regulations.
